Stonebrook Tree Violations

Stonebrook trees have been measured for compliance with city ordinances for minimum clearance over roads and sidewalks. Under applicable city ordinances, trees are to be trimmed from ground level to at least 15 feet above public streets, 13 feet above curb, and 8 feet above sidewalks. This notice is to inform you:

Further work is needed to meet the minimum clearance requirements.

If you have trees that need to be trimmed, you can do it yourself or hire a commercial service. Please Note: There are two different approaches to tree trimming:

  1. Trimming for Compliance: This type of trimming only addresses the minimum requirements for clearance over streets and sidewalks. While it ensures compliance with city ordinances, it typically needs to be redone every season as trees grow back quickly.

  2. Trimming for Long-Term Health: A more comprehensive approach to tree care not only meets compliance but also promotes healthy growth for the next 10 years. Proper trimming encourages better tree structure, reduces future maintenance, and supports the long-term health of the tree.

If you decide to trim your trees yourself or if you hire a service that trims but does not haul branches away, you may cut and tie severed branches into 4-foot bundles to be picked up by the City of Idaho Falls Sanitation Department by calling (208) 612-8491.

Mailbox Update

Mailbox update from September 5, 2022

The Stonebrook HOA Board of Directors along with the available Mailbox Captains met September 5, 2022 to discuss the status and next steps of the mailbox project. 

The HOA has been working with the USPS closely to roll out the new mailboxes for the neighborhood for over 6 months. The process lined out by the USPS has been followed however there is a clear stall in the process we have learned given mail delivery for some households has been paused. Any mail that has not been placed in the former silver cluster box unit (CBU) for each address is being held at the post office on 4th street. The problems that have arisen are surprising to the HOA given the legwork done ahead of install. The board is actively working to correct the problems as quickly as possible. The HOA is beholden to the USPS staff’s willingness to respond and coordinate the necessary details. 

 A few points to be aware of:

·  There are 316 homes in the Stonebrook subdivision. Currently there are 412 mail slots/boxes in the former silver CBUs. Meaning, the former silver CBUs hold 100 extra mail slots that are not for Stonebrook homes. This fact is why the locations of mailboxes for some has changed. The HOA made the decision to buy new mailboxes to service the 316 homes in Stonebrook subdivision. That does trigger a new route to be established for the mail.  Had the HOA purchased the same number of former silver CBUs, it would have again resulted in 100 extra mailslots/boxes that would be unused and remain empty 100% of the time. This would have been a substantial cost to the HOA. 

·  At no time was the HOA aware the USPS would hold or stop delivery of mail through this transition. Had the HOA known this could or would happen, the HOA would have left the former silver CBUs in place and installed the new boxes next to them, removing the former silver CBUs at a later date. The HOA believed the process and procedures were in place to move to the step to install the new mailboxes for mail delivery to be coordinated right away. 

·  The current solution the HOA has identified to resume mail delivery is to secure the former silver CBUs with straps and tables in the location of the former silver CBUs. If you are not comfortable with that solution for your mail to be delivered to the former location, the HOA has recommended you place your mail on hold. Follow this link to do so here. 

·  Upon placing your mail on hold, you can collect your mail daily at the 4th street post office. The hold can remain in place for 30 days. Picking up mail while the hold is absolutely possible.

·  The HOA Board of Directors are communicating regularly amongst each other to resolve this as quickly as possible.

A few additional clarifying points: 

·  The USPS has been engaged from the first step - the USPS has moved much slower than anticipated on the process. The HOA has proactively worked to roll out this process smoothly. We are as surprised that the process has not gone smoothly with the effort, time, and planning on the front end.  

·  The mailboxes were ordered from the USPS catalog of mailboxes and are indeed approved mailboxes by USPS.

·  The new mailboxes offer individual mailboxes twice the size as the former silver CBUs mailbox slots. They will fit 2 priority mailboxes in each box. 

·  Each new mailbox has one parcel locker. Should the package not fit in the individual mailbox slot, the parcel locker will be used. If the parcel locker is full, the package will likely be delivered to the home as is the current process for full parcel lockers.

The new mailboxes cannot be used until the USPS has confirmed the new routes. Stonebrook has 2 routes for mail delivery. The routes must be confirmed and approved by the local office and the Salt Lake City post office. We did not understand the timeline for this to be done was much longer than anticipated. The local USPS did not meet the promised timeline we understood them to agree to.  

The local mail delivery people from USPS have been extremely patient and helpful. They seem to be delivering mail as they can to households and temporarily secured former silver CBUs. Any delay is not their fault. They are executing the instructions from the 4th street post office.

9/4/2022 DRAFT September CBU Labeling USPS posted on mailboxes HOA Message: Homeowners, please write your house number on the exterior door of the old CBU boxes with a sharpie. Within Stonebrook HOA there are 412 mailbox slots. Stonebrook HOA only has 316 homes and purchased 316 new mailbox slots.  The HOA continues to volunteer time & energy to identify box locations and discuss best options with USPS.

If Privately owned or maintained by a landlord, apartment complex, condo association or other housing group, then that management is responsible for maintaining the box including keys.

If the box is owned and maintained by the US Postal Service and is damaged/broken then contact your local Post Office.

If the LPO does not service the mailbox, this means the property owner or manager is responsible for the maintenance.

We have temporarily secured the old box to continue neighborhood delivery services. We are seeking other volunteers to secure old mailboxes.

This is great and helpful to resolve the mail delivery delay! The hang up or delay to the new mailboxes receiving mail is on the USPS side. The new mailboxes are indeed approved from the USPS and were ordered from a USPS catalog for mailboxes. The issue is the rerouting process from the USPS side. The process to confirm the mail being delivered to the original CBU locations will provide the context USPS needs to perform their reroute. Surprisingly, USPS is not willing to help or proactively design the reroute so this is now falling on the HOA to do this legwork. There are 100 more mailboxes in the old CBU in the neighborhood than houses. Those extra 100 are empty and not used actively most likely within the old CBUs. USPS seems confused by the excess mailboxes thus why the HOA is confirming mailbox addresses in this manner.

20 of 25 mailboxes are ready to install (waiting on 5 pedestals to be delivered). All mailboxes are labeled. Contact your mailbox representative to get your new key. Mailboxes are starting to be installed tomorrow. Old mailboxes will be taken down and hauled off once all the mail has been removed and the USPS transition is complete.

USPS will be installing the final step of postmaster keys onto the new mailboxes.

HOA Board Meeting Notes

RE: Community Mailboxes

June 14, 2022

Mailboxes were ordered in November 2021. Concrete bolts were delivered in December 2021. Finally, June 2022 we received the first shipment of 13 cluster mailboxes. The remaining 12 cluster boxes and decorative pieces are still on backorder, estimated to arrive by August 2022. 

 

During our HOA Board Meeting we reached a final decision to present HOA DRAFT for Postmaster mailbox map to the Idaho Falls Postmaster on Tuesday June 21, 2022. Note: HOA Board goal is to place all homeowners to their closest walking distance mailbox cluster. We propose to move cluster box #17 out of the Charleston Lane cul de sac and onto shared concrete paid with cluster box #18. Proposal to place new installation of cluster box #13 on Woodhaven Lane. Old mailboxes will be salvaged for scrap metal by Craig Hill and Paul Greenwood.  

Box numbers do not represent final box location. Idaho Falls USPS Postmaster will be making final decisions. Working together with the Stonebrook HOA Board and USPS to create an installation schedule that will be distributed to the community. Following the final decisions by the Postmaster a new key distribution list with details and schedule will be available for all homeowners.

October 18, 2021: Meeting Summary

Dear Stonebrook Homeowners, 

Thank you to all who attended the Special HOA Meeting on Monday, October 18, 2021. Click on the two links to view the presentations given:

In summary, Homeowners can text violation addresses & pictures to (208) 718-2366 to report violations. Our neighborhood boasts many beautiful fall leaves this time of year. October is a great time to get outside and serve our neighborhood by trimming your trees to the correct height off the street, curb, and sidewalk. In our final push for Stonebrook beautification, the HOA has planted 30 trees missing in the park strip. Every homeowner is responsible for maintaining their tree(s) to a height of not less than 8 feet above any public sidewalk, thirteen feet from the back of the curb angled up toward the centerline to a height of not less than fifteen feet above any public street or alley. We have replaced the broken lights on the main entrance cobblestone wall highlighting the Stonebrook signage. 

The Stonebrook HOA Board has voted to replace all mailboxes working closely with the USPS Postmaster to redistribute 25 cluster boxes, click here for Decorative 13-door CBU description, evenly throughout the community. We currently have 412 mailboxes in Stonebrook which leaves 96 vacant mailboxes on our 24 existing cement pads. The HOA voted to contribute $100 per household mailbox ($31,600) and a special assessment of $80 per household ($25,280) will be collected for the remaining balance. In the future, the HOA will continue to budget and save money for the main entrance sprinkler system, sidewalk concrete repair, and emergencies. A reminder that every homeowner is responsible for maintaining their public sidewalk. Gustavo Alcantara, the owner of Underground Landscaping, is willing to work with Stonebrook Homeowners for a group discount for driveway, sidewalk, and mailbox snow removal. Our efforts to modernize the covenants are moving forward. Stonebrook Residents,

The Stonebrook HOA Board is calling a SPECIAL MEETING on Monday, October 18, 2021, at 8pm, at Sunnyside Elementary School: 165 Cobblestone Lane, Idaho Falls, ID 83404. This special meeting will begin the process of modernizing and consolidating our 20+ year old community. 

This meeting has been called to address the important issues with our Stonebrook Protective Covenants.  Since 2019, the Stonebrook Board has been working to collect feedback and input from Stonebrook Homeowners on how best to address outdated items and compile the
16 separate divisions into one continuous Stonebrook Community.  On October 13, 2020,
The Stonebrook Board Representatives and Property Manager held a meeting with Peter Christofferson of Holden Kidwell Hahn & Crapo Law Offices to continue forward with modernizing the original Stonebrook Home Owners Association Covenants, Conditions, & Restrictions.  Please visit the website www.stonebrookhomeowners.org/ccrs and take time to review the proposed 2020 modernized Covenants, Conditions, and Restrictions for Stonebrook Homeowners Association side by side with our original covenants created on April 28, 1986.

It is time to modernize and consolidate to best protect our subdivision.  Some believe our current covenants leave the Home Owners Association and residents open to liability on the whole of our neighborhood. We need participation from a large majority of residents to address this issue. Every homeowner should take an interest to understand and vote on the upcoming changes. Stonebrook Homeowners Association 16 DIVISIONS Protective Covenants

The covenants running with the land can be changed at two different times, with different rules as to each.  First, the covenants can be AMENDED which can happen at ANY time, no matter what.  That requires a 75% vote to accomplish. Second, the covenants can be MODIFIED.  The covenants were set up to last 20 years and then to automatically renew for 10 years at a time after that UNLESS a document signed by a MAJORITY (50%) of the current homeowners in the division is recorded with Bonneville County prior to the renewal date (the twentieth, thirtieth, fortieth anniversary, etc. of the date the covenants were first recorded).

The Stonebrook HOA mailboxes are in need of replacement.

At the meeting on Monday, October 18, 2021 we will be requesting feedback on our final mailbox replacement plan. We have photographed all mailboxes, met with the Post Master, interviewed many homeowners and have finalized our plan to move forward with replacing the mailboxes, some of which are over 35+ years old! Come and see!

Stonebrook Tree Replacement Letter

October 6, 2021

Stonebrook Resident,

According to our covenants, you are in violation of the Tree Covenant for Stonebrook Home Owners Association: TREES [Division 1, Division 2, Division 3, Division 4, Division 5, Division 6, Division 7, Division 8, Division 9, Division 10, Division 11, Division 12, Division 13, Division 14, Division 15, Division 16]. Grantors will plant one or two trees on the front of each lot depending on width of lot. The purchaser of each lot will be required to maintain such trees.

Apart from our covenants requirement, we know as Stonebrook homeowners what great beauty and value these trees add to our neighborhood, especially during this time of year!!

That said, the Stonebrook Home Owners Association has selected YOUR HOUSE as one of thirty homes that will receive a planted 25-gallon Ash Tree(s) on the front or side of your lot (depending on the width of lot) during the weeks of October 11 to October 22, 2021. We will be providing a 7+ year old mature tree with an approximate 2+ inch trunk and 15-foot height, however, you will be required to maintain the tree.

Trees purchased at R&D Wholesale Nursery. Trees planted by Underground Landscaping. 

If you have any concerns, please contact the Stonebrook HOA Property Management via our website at www.stonebrookhomeowners.org/contact 

R&D Wholesale Nursery will guarantee the provided Ash tree for 12 months if properly planted and cared for. If you would like to purchase, dig, and plant your own tree please let us know as soon as possible. Underground Landscaping will be fixing any sprinkler line damage they cause during the digging and planting of said trees.

PLANTING AN ASH TREE

The Ash tree is planted in fall in ordinary soil, either enriched or naturally so. It’s important to plant your ash tree in a luminous spot of the garden, away from other trees.

HOW TO PLANT YOUR ASH TREE

The ash tree must grow in a luminous and sunny spot. Before planting it in your garden, check that its growth won’t be impeded by any nearby wall, building, or even another tree. After that, dig a hole of an average depth. Wet the clump a bit, and place it in the hole.

Press the soil down around the trunk and water abundantly. Since it grows tall, try to keep a strict minimum of at least 20 feet (6 m) from house walls. Having 30 feet (10 m) or more is best to avoid issues later on.

Autumn is the best season to plant ash trees because the winter colds slow their growth. September and October are thus the best months to plant your ash tree. If you live in a very windy spot, placing a stake in the ground to keep the plant upright will keep it from toppling over and is strongly recommended.

PRUNING AN ASH TREE

The pruning, if needed, should be performed in October. No pruning is formally required. If you let your ash tree grow without pruning it, it will take on a very elegant shape. You can still eliminate deadwood and the most fragile branches.

CARING FOR AN ASH TREE

The ash tree won’t require any care, and doesn’t also need any pruning. If you feel your soil is very poor, you can help it with a very small dose of fertilizer (phosphorus and potassium) during the first few months. The growth phase of this tree is in spring (before the blooming). The blooming lasts from March to May. At the beginning of spring, remember to remove undesirable buds from the trunk.  Psyllids (which are sap-suckers) look like small grasshoppers and often spread diseases. They can harm a tree quite a lot. Overall, though, ash is a very resilient tree.

TYPES OF FLATHEAD BORERS MOST COMMONLY FOUND IN SOUTHEAST IDAHO

Emerald Ash Borer (Agrillus planipennis) adults are distinctive dark metallic green beetles that are about 1/2 long and about 1/8 inches wide. This invasive insect, which has killed hundreds of millions of ash trees in North America, was discovered in Kentucky in 2009. The larvae feed on the inner bark of ash trees from June through October, disrupting the tree's ability to transport water and nutrients. Unless protected, infested trees usually die within 4 to 7 years of attack. All native ash species are susceptible to attack. The insect has been found recently in white fringetree (Chionanthus virginicus). 

Ash trees can be protected from attack by this devastating insect by:

  1. Systemic insecticide applied by soil injection or soil drench; OR

  2. Micro tree injection.

TREES

STONEBROOK HOA SIDEWALK EASEMENT PERMITTED TREES:

As a reminder Homeowners can plant any other tree in their front yard, but for the Stonebrook HOA Sidewalk easement park strips you must use the permitted trees only for HOA uniformity.

The owner of each lot will be required to have or plant one or two trees on the front of each lot depending on width of lot with a maximum of four trees per park strip. No tree may be planted in any park strip area (located between the sidewalk and the curb) unless the tree is of a species that can be found on a list of acceptable species that is to be created and maintained by the Board.

The Association may require that trees disturbing the sidewalk be replaced and that the sidewalk be repaired. The owner of each lot will further be required to maintain such trees in the manner required by the city ordinances of Idaho Falls, Idaho.  Each owner shall further be responsible to replace said trees as necessary.

If you have a tree of a different variety grandfathered in please register your tree with the Stonebrook HOA Board. If you would like to replace a tree that is not on the permitted list contact the Stonebrook HOA Property Management via our website at www.stonebrookhomeowners.org/contact and you will receive a planted 25-gallon Ash Tree(s) on the front or side of your lot (depending on the width of lot) with an approximate 2+ inch trunk and 15-foot height, however, you will be required to maintain the tree.

ARTICLE IV

Meeting of Members

Section 1.

All meetings of the members shall be held in the City of Idaho Falls, Idaho, or they may be held at such other place as shall be determined from time to time by the Board of Directors, and the place at which such meeting shall be held shall be stated in the notice and call of the meeting.

Section 2.

The annual meeting of the members shall be held during the month of August at such time and date as determined by the Board of Directors. At this meeting, the directors for the ensuing year shall be nominated, the officers of the corporation shall present their annual reports and business initially raised at the annual meeting shall be by written ballot distributed by mail.  All items of business of which the members have proper notice in advance of the annual meeting shall be voted on at such meeting.  If the annual meeting of the members be not held as herein provided, then election of directors may be held at any meeting thereafter called pursuant to these By-Laws.

All elections for directors shall be by written ballot and the candidates receiving the highest number of votes shall be declared elected.  The ballots shall be distributed by mail and shall be collected by the Board of Directors.  The Directors shall count the votes and announce the results no later than 30 days after the election.

Section 3.

Each member entitled to vote may be represented at any regular or special meeting of members by a duly executed proxy which shall be in writing and properly signed, but shall require no other – attestation. No proxy shall be recognized unless executed within eleven months of the date of the meeting at which it is presented.

Section 4.

Special meetings of the members may be held whenever called by the Board of Directors, or by a majority of the members thereof, or by the President, and shall be called by the President of Vice-President upon the request in writing by ten percent (10%) of the members.  Calls for special meetings shall state the time, place and object or objects thereof, and no business other than that specified in the call shall be considered at such meeting.

Section 5.

A written or printed notice of every regular or special meeting of members stating the time and place, and in case of special meetings, the objects thereof, shall be prepared and mailed by the Secretary, postage prepaid, to the last known post office address of each member at least ten (10) days before the date of any such meeting, or delivered in person at least ten (10) days before the date of any such meeting.

Notice of the time, place and purpose of any meeting of the members shall not be required to be given to any member who shall attend such meeting, in person or by proxy; and if any member, in writing or by telegraphic wire, filed with the records of the meeting, either before or after the holding thereof, shall waive notice of any members’ meeting, notice thereof need not be given to him.  No notice of an adjourned meeting of the members need be given.

Section 6.

Except as may otherwise be provided by law, or in the Articles of Incorporation, a quorum at any annual or special meeting of members shall consist of ten percent (10%) of the members represented either in person or by proxy.  When a quorum is present at any meeting, a majority of the members represented thereat shall decide any question brought before such meeting, unless otherwise expressly provided by law.  In the absence of a quorum, those present may adjourn the meeting to another day, but until a quorum is secured, no business may be transacted; provided, however, that in case of any meeting called for the election of directors, those who attend the second of such adjourned meetings, although less than a quorum, shall nevertheless, constitute a quorum for the purpose of electing directors. At any adjourned meeting when a quorum is present any business may be transacted which would have been proper at the original meeting.

Section 7.

The President, or in his absence, the Vice-President, shall preside at all meetings of the members. In the absence of both the President and Vice-President, those present and entitled to vote at the meeting shall elect a presiding officer.

Section 8.

Any action required to be taken at a meeting of the members, or any other action which may be taken at a meeting of members, may be taken without a meeting if a consent in writing, setting forth the action so taken, shall be signed by all of the members entitled to vote with respect to the subject matter thereof, in accordance with the applicable provisions of the Idaho Code.

You can protect yourself and help prevent spreading the virus to others if you wash your hands regularly for 20 seconds, with soap and water or alcohol-based hand rub, cover your nose and mouth with a disposable tissue or flexed elbow when you cough or sneeze, avoid close contact (6 feet) with people who are unwell, stay home and self-isolate from others in the household if you feel unwell, and don’t touch your eyes, nose, or mouth if your hands are not clean. 

We have postponed all Stonebrook HOA gatherings until further notice.
